A general terms and conditions agreement describes the Web site administrator’s rules regarding user behavior and provides information about the actions the Web site administrator can and will take. Your terms and conditions are a contract between your website and its users. In the event of a legal dispute, arbitrators will look to this agreement to determine whether each party has acted within its rights.
Terms and conditions are not required by law, but they are very important for the long-term success and viability of your website.
Having terms and conditions for Web sites is considered standard business practice in the U.S., Canada, the U.K. and just about everywhere else – from South Africa to Australia.
The General Data Protection Regulation (GDPR) – Europe’s strict privacy laws that apply globally to businesses with EU users – does not directly affect your website’s terms and conditions.
While the GDPR does not dictate what must be in your terms and conditions, it does require you to create a separate website privacy policy, much like the recently passed California Consumer Privacy Act (CCPA). Check out our CCPA vs GDPR infographic to understand the differences between these two laws.
